Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Dicy application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Dicy is a screen time management application that helps users manage their app usage through a dice-based behavioral training system and Focus Mode timers. The App uses Apple's Screen Time API to restrict and manage app access on your device.

3. Account Registration

To use Dicy, you must create an account using a valid email address or Apple Sign In. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information when creating your account. You must be at least 13 years old to use the App.

4. Subscriptions and Payments

Dicy requires an active subscription to access the App's features. The following subscription options are available:

Dicy Weekly

The weekly subscription is billed at $4.99 per week. The subscription automatically renews each week unless cancelled at least 24 hours before the end of the current billing period.

Dicy Yearly

The yearly subscription is billed at $49.99 per year (equivalent to approximately $0.96 per week). The subscription automatically renews each year unless cancelled at least 24 hours before the end of the current billing period.

Payment Processing

All payments are processed through Apple's App Store. By subscribing, you agree to Apple's payment terms. Prices are subject to change, but any price changes will not affect active subscriptions until renewal.

Auto-Renewal

All subscriptions are auto-renewable. Payment will be charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same rate.

5. Cancellation and Refunds

You may cancel your subscription at any time through your Apple ID settings or through the "Manage Subscription" option in the App's Settings. Cancellation takes effect at the end of the current billing period. You will retain access to the App's features until the end of your paid period. No partial refunds are provided for unused portions of a billing period.

Refund requests must be submitted directly to Apple through their standard refund process at reportaproblem.apple.com. Dicy does not process refunds directly as all transactions are handled by Apple.

6. Onboarding Data

During the onboarding process, we collect information about your screen time goals, the effects of screen time on your life, your daily screen time estimate, and your age category. This data is used solely to personalize your experience within the App and to provide relevant insights about your screen time habits. This data is not shared with third parties for advertising purposes.

7. User Conduct

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use the App to circumvent parental controls set by another person
• Create multiple accounts to circumvent subscription requirements

8. Intellectual Property

The App, including its design, code, mascot character, and all content, is the intellectual property of Dicy and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that it will effectively reduce your screen time. Results depend on individual usage and commitment.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Dicy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, arising out of or related to your use of the App.

Our total liability for any claims arising from your use of the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

11. Screen Time API & Focus Mode Disclaimer

Dicy uses Apple's Screen Time API (FamilyControls framework) to manage app restrictions. The availability and functionality of this feature depends on Apple's APIs and your device's capabilities. Furthermore, when using the Focus Timer feature, selected apps will be completely blocked for the duration you specify. You acknowledge that Dicy is not responsible for any missed communications, emergencies, or other consequences resulting from apps being intentionally blocked by Focus Mode. We are not responsible for any limitations, changes, or issues related to Apple's Screen Time functionality.

12. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms. Upon termination, your right to use the App ceases immediately. You may also delete your account at any time through the App settings.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify users of material changes through the App or via email.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Dicy operates, without regard to conflict of law principles.
